Back by popular demand (people keep messaging me), here is CAPE Phase II, here is what you need to know:
For the dummies
- Did you import products last year? If yes then you paid IEEPA tariffs, which were illegal, entitling you to a refund.
- CBP is rolling out refund eligibility in PHASES., which are determined by the type of entry you imported (more on this below)
- The administration doesnt want to give you your money back. Theyre already appealing to argue that importers who missed their PHASE I or PHASE II refund filings (aka those with entries in final liquidation) shouldn’t get refunded without personally filing a lawsuit. Being in final liq doesnt make you a bad person; lots of entries started out that way bc they entered over a year ago. tough break. Bottom line: get your money before the Admin cuts you out.
Phase II: Electric Boogaloo
- If your entries are standard and not yet final liq, you need to file Phase I
- Phase II opened June 29, my birthday 🙂 btw, and is available NOW!
- Are you Phase II?
- Any entries flagged for reconciliation (types 01, 02, 06). Not flagged for recon=you’re not phase II. You might still be Phase I though, so file now unless you’re in final liq!
- How to file?
- Honestly its the exact same as Phase I, just follow my reddit guide on setting up an ACE account , pulling an es-003 report, prep’ing your declaration, and tracking it, and you’ll be fine
