Hey guys, I’m making this post on behalf of my dad. He has owned a restaurant in California for about 15. Since COVID, the restaurant has taken a very bad hit and it is currently losing money every month. My father has two other jobs now to help cover family expenses and uses his money from those jobs to cover expenses of the business including payroll and his lease. The lease is his biggest cost right now and doesnt expire until 2033. There is no lease break clause in the agreement.
Has anyone had success breaking a lease like this due to financial hardship either through talking to the landlord or legal means? I’m thinking of telling him to offer 3 months of rent to the landlord in order to break the lease, but Im not sure if that is the best course of action. Will bankruptcy help? The lease is in the business’s name but my dad is a guarantor on the agreement.
